INFORMATION ON THE PRIVACY OF THE "HELP FAMILY" APP General
HELP FAMILY was born as a commercial App and undertakes to take all necessary precautions to protect the privacy of Users and Users of the Service. This page informs the User of the privacy policy for the use of the "Tracking and Tracking" application, or the policies regarding the collection, use and disclosure of Personal Data when the Service is used. It should be noted that the User's Personal Data are collected and used in order to provide the Service and make it usable and functional, in accordance with the provisions of the methods of use and in compliance with the legislation referred to in the GDPR (EU Regulation 2016/679 in force since 25.05.2018). The information and data collected will be used to provide and improve the Service and will not be used for purposes other than or exceeding those described in this Notice.
We reserve the right to modify and / or update this Privacy Policy, informing the User through the methods deemed most appropriate. The use of the Services will result in the acceptance of the Privacy Policy as amended. Periodic consultation of the Privacy Policy is recommended By using the Service, the User accepts the collection and use of information in accordance with this policy which, in compliance with the relevant regulations, provides that the treatments carried out are always based on the principles of lawfulness, correctness, transparency, purpose limitation and data retention and minimization, integrity, accuracy and confidentiality. 1. Owner of the data processing
The data controller is the subject who (possibly in collaboration with third parties) determines the purposes and the way in which the Personal Data are or will be processed and processed. For the purposes of this Privacy Policy, the data controller is responsible for the information of Users who use our Services through the APP. 2. The Personal Data being processed
By installing the "HELP FAMILY" App on your Device, we inform you that it will process all Personal Data in order to allow the correct and optimal functioning of the Service. The data collected and processed may consist of: Personal Data whose processing is aimed at identifying the User; data concerning the Device in order to guarantee the correct and optimal functioning of the Service; data concerning the position and geolocation for the purposes of the Service; any other data provided voluntarily by the User for the better functioning of the system or to access additional Services.
3. Data about your Device
By consenting to the installation of the "HELP FAMILY" application, you automatically authorize the installation of the APP on your Mobile Device as well as give your consent for some data present in it to be read, whose access is necessary to allow correct installation and the correct
functioning of the application. By installing the "HELP FAMILY" APP, you consent to access any information relating to the Device, such as: the model of the Device, the IP address, the telephone number, the version of the operating system, the browser, system updates, screen resolution, any information relating to network connection and battery level, language settings, information relating to the interactions of apps, browsers and devices with our Services, reports on operations or anomalous interruptions, information on date and time and any other identification data of the Device necessary for the operation of the Service. This is information whose sharing is inherent in the installation of applications, the refusal of which would in itself make it impossible to install and operate the APP and the related Service.
4. Data concerning the Position
With the installation of the APP, information on the position of the person connected to your own APP is used and stored, that is, having also downloaded and installed it, in order to allow the APP and the Service to function. Specifically, the tracing and / or tracking system makes it possible to trace the person who has suffered an impact, a fall or an accident thanks to the movement as well as the jolt that the mobile phone of the injured person undergoes, as well as allowing you to check where the person is. at a precise moment, for example your child. The APP sends, via SIM, the GPS coordinates and in the event of a fall, impact, accident through the sound of the alarm for the duration of time chosen by the person who suffers this impact, it is activated by reflex on your mobile phone allowing you to see where the accident is found, which are stored. This information is encrypted and kept within the cloud infrastructure. The user, through the APP, can consult them for the use of the services offered. The App through GPS coordinates ensures:
- the identification of the place where the accident or fall of the person to whom the alarm was triggered took place;
- the possibility of connecting the tracing system for up to five people;
- the possibility of deciding the duration of the alarm time in the event of a fall / jolt / accident even on foot.
For the performance of this Service, the "HELP FAMILY" APP has access to the data relating to the position and GPS coordinates of the mobile phone of the person to whom the APP is connected, as communicated via sim, therefore, to the user. viewable by accessing the APP. The consent to the processing of data relating to the position of the sim and the vehicle is essential for the functioning of the system. However, the protection of Users' privacy is our primary goal. The processing of location data, as necessary for the operation of the Service, provides for forms of storage of sensitive data such as to prevent full access to them without the use of decryption systems, as better explained in the part relating to data retention.
5. Personal data of the interested party
The use of our Service presupposes the processing of Personal Data, or some information that we can use to contact or identify you, such as registration data (name and surname), and email address. Any additions of personal data that will be entered voluntarily and optionally in the APP will not be necessary for the operation of the service and will remain stored exclusively in your device.
6. Purpose of the treatment
The processing of the above data by the App has the following purposes:
a) Allow the provision of the Services requested by you, that is: monitoring the position of the people connected with you to the APP and identifying authorized movements of the same, through the combined use of the APP installed on both devices, as well as to identify the place where a fall / accident may occur following which the alarm will start to sound for the duration of the time established by the person who suffered the fall / accident;
b) Carry out profiling activities strictly related to providing you with the Services requested by you. The legal basis for the processing of Personal Data, data relating to the Device and
Geolocation for the purposes referred to in points 3a, 3b and 3c is art. 6 c. 1 letter b) of EU Regulation no. 679/2016, as this data processing is necessary for the provision of the Services and therefore "the processing is necessary for the execution of a contract of which the interested party is a party or for the execution of pre-contractual measures adopted at the request of the same" . The provision of Personal Data for these purposes is optional but failure to provide it would make it impossible to activate and / or use the Services provided by the system.
d) To fulfill any legal, accounting and tax obligations;
e) Promote safety and protection inside and outside the Services, for example by analyzing suspicious activities or violations of the Terms, to ensure the lawful use of the Services; to identify, analyze, prevent and manage fraud and other illegal activities or technical or security problems; all in order to protect the rights, property and safety of Users and / or third parties. The legal basis for the processing of Personal Data for the purposes referred to in points 3d and 3e is art. 6 c.1 lett. c) of the EU Regulation no. 679/2016 as, having given consent to the processing of Personal Data, the processing in these terms becomes necessary to fulfill a legal obligation to which the data controller is subject.
f) Develop studies, research, market statistics, send you advertising, information, commercial information or surveys to improve the App ("customer satisfaction") via e-mail or via information/advertising banners within the App.
7. Transfers of Personal Data
Your Personal Data are processed and stored within the European Union, but, for the purpose of better providing the Service, they may be shared with third parties that may be located outside the European Economic Area. The "HELP FAMILY" App will take all necessary measures to ensure that your data is treated securely and in accordance with this Privacy Policy and that no transfer of your Personal Data
will take place to an organization or country unless that there are no adequate controls over your data and other personal information.
8. Data retention
Your Personal Data may be shared, for the aforementioned purposes, with: to. the subjects responsible for the processing, namely: i) persons, companies or professional firms that provide assistance in accounting, administrative, tax and financial matters; ii) subjects with whom it is necessary to interact for the provision of the Services (for example hosting providers or platform suppliers for sending e-mails); iii) subjects delegated to carry out technical maintenance activities (including maintenance of network and electronic communications networks); iv) persons authorized to process data in compliance with the guarantees of confidentiality or with the assumption of legal obligations of confidentiality (such as technical employees);
b. subjects, bodies or authorities to whom it is mandatory to communicate your Personal Data by virtue of legal provisions or orders of the authorities.
The Personal Data processed for the purposes referred to above lett. 3a, 3b and 3c will be kept for the time strictly necessary to achieve those same purposes. In any case, since these are treatments carried out for the provision of Services, pursuant to art. 6 c.1 lett. b), the APP will retain Personal Data up to the time allowed by Italian law to protect its interests (Article 2946 of the Italian Civil Code and subsequent amendments). The Personal Data processed for the purposes referred to in section 3d and 3e will be kept for the time necessary to fulfill the specific obligation or applicable law. For the purposes referred to in section 3 f), your Personal Data will instead be processed until the revocation of your consent and / or until you have opposed it. In any case, the possibility is reserved for "HELP FAMILY" to keep your Personal Data up to the time allowed by Italian law to protect its interests (Art. 2947c.c.). The "HELP FAMILY" APP is particularly attentive to the privacy of Users, therefore we want to ensure maximum clarity regarding the processing of data
relating to location and geolocation, since these are data from which sensitive data can be obtained. Therefore, the storage of such data will take place using encryption systems (AES) in order to prevent third parties from having access to sensitive data.

9. Rights of interested parties
Pursuant to the Applicable Law, the Data Controller informs that Users have the right to obtain indication (i) of the origin of personal data; (ii) the purposes and methods of the processing; (iii) the logic applied in case of processing carried out with the aid of electronic tools; (iv) the identity of the owner and managers; (v) the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as managers or agents. Furthermore, Users have the right to obtain:
1. access, updating, rectification or, when interested, integration of data;
2. the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data which need not be kept for the purposes for which the data were collected or subsequently processed;
3. the attestation that the operations referred to in letters 1) and 2) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case where this fulfillment it proves impossible or involves the use of means that are manifestly disproportionate to the protected right.
Furthermore, Users have:
1. the right to withdraw consent at any time, if the processing is based on their consent; 2. the right to data portability (right to receive all personal data concerning them in a structured format, commonly used and readable by automatic device), the right to limit the processing of personal data and the right to cancellation (" right to be forgotten ");
3. the right to object: in whole or in part, for legitimate reasons, to the processing of personal data concerning them, even if pertinent to the purpose of the collection but will therefore not be able to use the APP;
4. if they believe that the processing that concerns them violates the Regulation, the right to lodge a complaint with a Supervisory Authority (in the Member State in which they usually reside, in the one in which they work or in the one in which the alleged violation has occurred ).
